CattleController – Terms of
Service
Terms and Conditions of Service
Users of the CattleController Ltd
(“CattleController”) web-site are required to agree with the following terms
and conditions in order to make use of the CattleController service (“Service”)
and/or access supplemental information (“Information”) on the site.
United Kingdom Jurisdiction
The Information and Service is
designed for the use of cattle farmers in the United Kingdom. CattleController
cannot be held responsible for users from any other jurisdiction who view the
Information or make use of the Service in any other context.
Limitation of liability
CattleController undertakes to
supply the Service as a record keeping aid to farmers. Many of these records
are required by law and users are responsible for keeping regularly printed
copies of their records. While CattleController aims to supply the highest
level of service to its users, CattleController does not guarantee that the
Service will be uninterrupted or error free and cannot be held liable for
losses resulting from unavailability of the Service or inaccuracies in the
Service.
Security
You will be allocated a password
on registration with the Service. You are entirely responsible for maintaining
the confidentiality of that password. Furthermore, you are entirely responsible
for any and all activities that are processed or entered under your account.
CattleController acts as though any communications it receives under your
account name or name and/or password is sent by you. Please take steps to
ensure the integrity of your account name and the limitation of use of your
password.
Access Rights

By
agreeing to these Terms of Service, CattleController grants you the licence to
make use of the Service to manage your own stock records.

If you
wish to use the Service to manage herd records on behalf of others, you may do
so only by creating a separate account for each herd.
Your obligation to pay subscription fees

The
CattleController Service is offered on a subscription basis only. On
registering, you agree to pay all subscriptions and fees that CattleController
charges for the Service. These fees will commence after any period of free use
specifically agreed between you and CattleController.

Fees will paid by standing order monthly, in advance,
for the following month’s Service.

In the
event of late or non-payment, your account will be suspended and you will be
unable to log into the Service or access your stock records through either a
web-browser or WAP phone.

In the
event of non-payment of your subscription, CattleController reserves the right
to cancel your account and delete any stock data held in CattleController’s
database.
Subscription Rates

The
current subscription rate is £10 + VAT per calendar month. This rate covers
all aspects of the Service at the time of its launch.

CattleController reserves the right to change the
subscription rate in the future and to offer different parts of the Service at
different rates as options (for example, to offer extended WAP access as a
supplement to the main browser based service). CattleController will give you
1 month notice of any changes to the subscription rate.
Cattle Passport
Applications and Movement Notifications

CattleController will send Passport Applications and
Cattle Movement data to the British Cattle Movement Service (BCMS) on your behalf
if you instruct us to by clicking on the appropriate
button on the screen. The data will be sent directly to the
BCMS.

You understand that all Cattle
Passports supplied from data transmitted by CattleController will be based on
the information that you supply to CattleController. You also understand that
any Cattle Passport issued for a domestic male bovine as a result of any
passport applications will also serve as subsidy documents (CID/CDD) in
relation to the Beef Special Premium Scheme (BSPS).

You will not make any
duplicate applications for Cattle Passports or CID/CDD documents.

The information submitted to
CattleController will be correct to the best of your knowledge.

You agree that any inspector or
veterinary inspector appointed by the appropriate Minister of local authority,
accompanied by any person he considers neccessary, may enter your holding or
holdings to check the accuracy of details submitted to CattleController. You
will give all reasonable assistance to such persons.

You must sign and return these
Terms of Service before CattleController will activate your account for
sending data to the BCMS.
Ability to Terminate Service

You agree
that CattleController may terminate your account and discard the data
contained, at its sole discretion for any reason including, but not limited
to, lack of use or if CattleController believes you have violated or acted
inconsistently with the letter or spirit of these Terms of Service.

CattleController may also in its sole discretion and at
any time discontinue providing the Service with or without notice.

In the
event that your Service with CattleController terminates, CattleController
will use commercially reasonable efforts to return your stock records to you
electronically, in an appropriate format selected by CattleController, as
promptly as is reasonably possible after such termination, provided you have
complied with the Terms of Service and have paid in full all amounts owed to
CattleController.

You may
terminate your account with CattleController at any time, provided you have
paid in full all amounts owed to CattleController, by writing to
admin@CattleController.com.
Links and Advertisers
CattleController has no control
over the sites that it provides links to either as part of the Service or in
the form of advertising. Your dealings with these sites, including payment and
delivery of related goods and services and any other representations with such
dealings are solely between you and the site in question.

The name CattleController, the
Service supplied, and all content of the web-site, including these terms of
service are copyright of CattleController Ltd.
